Distance Sales Agreement

Contract terms governing the remote sale of MimiTone digital services.

1. Parties

Seller / Service Provider

Buyer / User

The buyer is the person whose name, contact details, billing information, selected plan, and order details are recorded during account creation and purchase.

2. Subject

This agreement governs the remote sale and delivery of MimiTone's digital text-to-speech, dubbing, transcription, editing, credit, project, and related services under applicable Turkish consumer law.

3. Service and order information

The plan name, scope, monthly credits, Studio project allowance, duration, price, currency, taxes, and additional charges are displayed in the plan and order summary before payment. The buyer must review and confirm this information.

4. Price and payment

The amount shown in the final payment summary is charged using the selected payment method. Bank, card issuer, exchange-rate, or cross-border transaction fees not collected by MimiTone are subject to the relevant financial institution's rules.

5. Performance and delivery

Purchased digital usage rights are assigned to the buyer's account after successful payment and verification. Generated content is delivered digitally through the account, project screen, or download link.

6. Right of withdrawal

Under applicable Turkish consumer law, the right of withdrawal may not apply to digital content supplied immediately in electronic form or to services begun with the consumer's prior consent before the withdrawal period expires, where the legally required acknowledgement has been obtained. Non-waivable statutory rights remain reserved.

7. Buyer responsibilities

The buyer is responsible for accurate account and project information, for holding all rights and permissions required to process uploaded content, and for lawful use that does not infringe third-party rights.

8. Defective or incomplete service

Verified MimiTone-related defects, missing outputs, or incorrect deliveries will be assessed according to their nature. A correction, re-production, restoration of credits, or refund may be provided where appropriate.

9. Intellectual property

Rights in the MimiTone platform, software, interface, models, and service materials remain with their owners. The buyer remains responsible for uploaded content and may use outputs only as permitted by law, third-party rights, and plan terms.

10. Personal data

Personal data is processed in accordance with the Privacy Policy and Personal Data Protection Notice (KVKK).

11. Disputes and effective date

Applications may be made to competent Consumer Arbitration Committees, Consumer Courts, and other authorities under applicable Turkish consumer law. This agreement becomes effective upon the buyer's electronic approval.
